Viva Social — Terms of Service

Welcome to Viva Social. These Terms of Service ("Terms") govern your use of the Viva Social mobile application and vivasocial.online website (the "Service"), operated by Technology Advantages LLC ("we," "us"). By creating an account you accept these Terms.
1. Eligibility
You must be at least 18 years old and able to form a binding contract under the laws of your jurisdiction. By creating an account, you represent and warrant that you meet these requirements. We enforce the age gate at signup and reserve the right to terminate accounts whose holders are under 18.
You may not use the Service if you have been previously banned or are listed on a national prohibited-persons list.
2. Account
- One account per person. Creating duplicate accounts is grounds for termination.
- You are responsible for activity on your account. Notify us immediately at support@technologyadvantagesllc.com if you suspect unauthorised access.
- Keep your profile accurate. Misrepresenting your age, identity, or photos is grounds for termination.
3. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose, including harassment, stalking, fraud, solicitation, prostitution, or human trafficking.
- Post or share content that is sexually explicit, violent, hateful, or otherwise prohibited by our Community Guidelines.
- Impersonate another person, including a celebrity or fictional character.
- Use bots, scrapers, or automated tools.
- Reverse-engineer the Service or attempt to access systems not intended for public access.
- Share another user's information (photos, plans, contact info) without their consent.
- Use the Service to advertise, promote, or solicit business.
There is zero tolerance for objectionable content and abusive users. Objectionable content includes nudity and sexually explicit material, defamatory, harassing, threatening, hateful or discriminatory content, depictions or promotion of violence or illegal activity, solicitation or trafficking, any sexualisation of a minor, and impersonation. You agree not to post, send, or transmit it, and not to harass, threaten, stalk, defraud, or abuse another user.
We provide the tools to enforce this and you agree to use them: every profile and conversation carries a report control (including a child safety category) and a block control that takes effect immediately. We may remove any content and terminate any account that breaches this section, immediately, without notice, and at our sole discretion.
Violations may result in immediate suspension or termination, with no refund of any prepaid fees (none at MVP).
4. Content
- You retain ownership of your photos and content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content within the Service.
- If you believe content on the Service infringes your copyright, follow our Copyright and DMCA Policy. We terminate repeat infringers.
- We may remove content that violates our Community Guidelines or these Terms. We are not obligated to monitor content but we do moderate reports and Stream-flagged messages.
- Images sent in chat are screened by a server-side NSFW check before they are delivered. Profile photos are scanned server-side after upload and removed if they fail; reported photos are reviewed by a human moderator and taken down when they violate these Terms.
5. Verification
Identity verification is optional but encouraged. By choosing to verify, you authorise Stripe Identity to collect and process a government ID document and a live selfie to confirm you are a real adult. Stripe returns only a pass or fail result to us; passing grants the Verified badge.
6. Plans, Invitations, and Reservations
- An "invitation" is a non-binding proposal to meet at a specific venue and time.
- We do not guarantee the availability of any venue, table, or reservation.
- The OpenTable reservation flow leaves the Service; OpenTable's terms apply.
- We are not liable for what happens during in-person meetings. Use common sense; meet in public; share plans with a friend (we provide a one-tap mechanism).
7. Subscriptions and Payments
Viva Social is free to use. Some features are sold as an auto-renewing subscription or as a one-off day pass.

Annual plans are charged once for the year and work out cheaper per month than paying monthly. Day passes and message packs are one-time purchases and do not renew.
Allowances, and why they exist. Dinner requests are limited per 30 days, and on the free plan messages are limited to 5 per match per day. The limits exist so that no member can send unsolicited invitations or messages at scale, which is the most common way a dating service is abused. Paid plans raise the dinner request allowance and remove the message limit; they do not remove our ability to act on an account that is being used to contact people at scale.
Purchased messages do not expire and are used only after that day's free allowance is spent, so you never spend a purchased message while a free one is available.
How you pay. Purchases made in the iOS or Android app are processed by Apple or Google under their own terms, and are charged to the payment method on your App Store or Google Play account. We never receive or store your card details.
Auto-renewal. Monthly and annual subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the period ends. Day passes are one-time consumable purchases and do not renew.
How to cancel. Cancel at any time in Settings → Subscriptions on your device (App Store: Settings → your name → Subscriptions; Google Play: Play Store → Payments and subscriptions). Cancelling stops the next renewal; you keep the feature until the end of the period you have already paid for. Cancelling is as easy as subscribing, and we will never require you to call or email to cancel.
Refunds. Refunds for purchases made through Apple or Google are governed by their policies and are requested from them, not from us. Where a state or country gives you a statutory refund or cancellation right beyond that, those rights apply and are not waived by this section.
Price and plan changes. We will give you at least 30 days' notice before any price increase takes effect on an existing subscription, and you may cancel before it applies.
Statutory cancellation rights. A number of states regulate dating-service subscriptions specifically, and several give additional rights — including the right to cancel within a set period after purchase and receive a pro-rated refund, and additional rights for members who die or become disabled during a term, or who move outside the service area. Those rights apply to you where your state grants them, they override anything inconsistent in this section, and you can exercise them by writing to support@technologyadvantagesllc.com.
Failed payments. If a renewal payment fails, your paid features remain active until the end of the period you have already paid for.
8. Safety
- We do not conduct criminal background screenings on our members. This is stated in full, along with what the Verified badge does and does not mean, in our Safety Disclosure. Read it before you meet anyone.
- Block or report users at any time.
- The "Share plans with a friend" feature sends a one-time SMS link (or a link you can copy and share) with venue, time, and your match's first name + primary photo to a contact of your choosing. Use it.
- We cooperate with law enforcement on valid legal requests and may, at our discretion, disclose information to prevent imminent physical harm.
9. Termination
- You may delete your account at any time from Settings → Account → Delete account. A 30-day grace period applies; signing back in within that window cancels the deletion. After 30 days, your profile, photos, and credentials are permanently deleted (see Privacy Policy §6 for retention).
- We may suspend or terminate your account if you violate these Terms or our Community Guidelines, immediately and without notice in severe cases (e.g., harassment, underage misrepresentation, fraud).
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO REPRESENTATIONS ABOUT THE CONDUCT, IDENTITY, OR INTENT OF OTHER USERS. WE DO NOT CONDUCT BACKGROUND CHECKS BEYOND SELFIE VERIFICATION (WHICH CONFIRMS A PERSON MATCHES THEIR PHOTO, NOT THEIR HISTORY).
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER USERS.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS IS LIMITED TO $100 OR THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS, WHICHEVER IS GREATER.
Some jurisdictions do not allow these limitations; in those, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify and hold Technology Advantages LLC, its officers, directors, employees, and agents harmless from any claim arising from your use of the Service, your content, or your interactions with other users.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law principles. Any dispute will be resolved by binding arbitration in Essex County, New Jersey, under the rules of the American Arbitration Association — unless you opt out within 30 days of accepting these Terms by emailing support@technologyadvantagesllc.com.
Class action waiver. YOU AND WE EACH AGREE THAT ANY DISPUTE WILL BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Jury trial waiver. TO THE EXTENT ANY DISPUTE PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL.
Small claims. Either of us may bring an individual claim in small claims court instead of arbitration, if it qualifies.
Coordinated filings. If 25 or more similar arbitration demands are filed by or with the assistance of the same counsel or coordinated entity, the demands will be resolved in batches of no more than 50, one batch at a time, with a single arbitrator per batch, and the limitation period is tolled for demands awaiting their batch.
Severability. If the class action waiver above is found unenforceable as to a particular claim or request for relief, that claim or request is severed from arbitration and may proceed in court, while every other claim stays in arbitration. If any other provision of this section is found unenforceable, it is severed and the remainder of this section stays in force.
Opting out. The 30-day opt-out above applies to this entire section. Opting out does not affect any other part of these Terms.
EEA/UK users retain their rights under local consumer-protection law and may bring claims in their local courts.
14. Changes
We will notify you of material changes 30 days in advance via in-app notice + email. Continued use after the effective date constitutes acceptance.

16. Miscellaneous
- Entire agreement. These Terms, together with the documents listed above, are the entire agreement between you and us about the Service.
- Severability. If any provision is held unenforceable, it is modified to the minimum extent necessary or severed, and the rest stays in force.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither of us is liable for a failure to perform caused by events outside reasonable control.
