Viva Social — Law Enforcement Guidelines

These guidelines are for law enforcement officers seeking records from Technology Advantages LLC relating to the Viva Social service. They are published so that requests arrive in a form we can act on quickly, and so members understand what we will and will not disclose.
Nothing here waives any right or objection, and nothing here is legal advice.

Email is faster and is the preferred channel. Requests sent to support or to individual staff will be redirected and will lose time.
For emergencies involving a risk of death or serious physical injury, use the subject line "EMERGENCY DISCLOSURE REQUEST" and see §4 below.
1. What legal process we require
We are a United States provider. We disclose member records only as permitted by the Stored Communications Act, 18 U.S.C. §2701 et seq., and other applicable law.

We treat precise location coordinates as content. They are the most sensitive thing we hold and a warrant is required.
Foreign law enforcement should proceed through a Mutual Legal Assistance Treaty or letter rogatory. We do not respond directly to foreign process.
2. What a usable request contains
Vague requests take longer and are frequently returned. Include:
- The exact identifier: the phone number in E.164 format (+15555550100), the account UUID if you have it, or the profile link. A first name and a city is not an identifier; every member has only a first name.
- A date range. Open ended requests over the full life of an account are usually overbroad and we will ask you to narrow them.
- The specific categories of records sought, using the table above.
- Your name, agency, badge or ID number, direct phone number, and official email address.
- The case or reference number.
3. Preservation requests
We honour preservation requests under 18 U.S.C. §2703(f). Send the identifier and the categories to preserve to support@technologyadvantagesllc.com with the subject "PRESERVATION REQUEST".
We preserve for 90 days, extendable once for a further 90 days on request. Preservation freezes a copy; it does not disclose anything and it does not stop the member from continuing to use or delete their account.
This matters on Viva Social specifically. Account deletion runs a 30 day grace period and then a hard purge that removes the profile, photos and credentials outright. Once the purge completes the data is gone and we cannot produce it. If your investigation may need records, send a preservation request first and legal process after.
4. Emergency disclosure
Under 18 U.S.C. §2702(b)(8) and (c)(4) we may disclose records without legal process where we believe in good faith that an emergency involving danger of death or serious physical injury requires disclosure without delay.
Send to support@technologyadvantagesllc.com, subject "EMERGENCY DISCLOSURE REQUEST", and include:
- The nature of the emergency and the specific danger.
- Why the danger is imminent.
- The identifier of the account involved.
- Exactly what information is needed and how it will address the danger.
- Your name, agency, and a phone number we can call back to verify.
We evaluate these individually. Disclosure is discretionary, not automatic, and we will decline where the facts do not describe an imminent risk of death or serious injury.
5. Notice to members
Our policy is to notify a member before disclosing their records, with enough time to seek protective relief, unless:
- we are legally prohibited from doing so, for example by a non-disclosure order under 18 U.S.C. §2705(b) or a statute imposing secrecy,
- the request is an emergency disclosure under §4, or
- we believe notice would create a risk of harm to a child, to an identifiable person, or of destruction of evidence.
If you need notice delayed, obtain an order. We will not delay notice on the basis of a request alone.
6. What we do not have
Setting expectations early saves everyone time. We do not hold:
- Payment card or bank details. We do not process payments.
- Government ID documents or selfie images from verification. Those are held by Stripe, not by us. We hold only a session reference and a pass or fail result.
- Contact lists, call logs, SMS content, browsing history, or any data from your device outside the Viva Social app.
- Continuous location history. We hold a member's current active location while they are sharing it, not a movement trail.
- Content of chats that Stream has purged, or data past the retention periods published in our Privacy Policy.
7. Costs and testimony
We may seek reimbursement for costs of production as permitted by law. Requests for a custodian of records affidavit should be made at the time of the request. We do not provide expert testimony.
8. Civil and third party requests
Civil subpoenas, private party requests, and requests from members seeking another member's information go to support@technologyadvantagesllc.com and are evaluated separately. We object to civil requests for content, which the Stored Communications Act generally does not permit us to disclose.
Members seeking their own data do not need legal process: use Settings, Your data, Request export in the app, which returns everything we hold about you.
